2. How to Submit a Takedown Notice
To be effective under the Digital Millennium Copyright Act (17 U.S.C. § 512(c)(3)), your written notice must include all of the following:
- A physical or electronic signature of the copyright owner, or a person authorized to act on the owner's behalf.
- Identification of the copyrighted work you claim has been infringed (or, if multiple works are covered by a single notice, a representative list of them).
- Identification of the material you claim is infringing and that you want removed, with enough detail for us to locate it - for example, the board name, the project or comment in question, and the date you saw it.
- Your contact information: name, mailing address, telephone number, and email address.
- A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
An incomplete notice may not be effective, and may delay our response. If your notice is substantially complete, we will act on it expeditiously - typically by removing or disabling access to the material and notifying the user who posted it.
3. Counter-Notification
If your material was removed and you believe that was a mistake or misidentification, you may send us a counter-notification. To be effective under 17 U.S.C. § 512(g)(3), it must include:
- Your physical or electronic signature.
- Identification of the material that was removed and the location where it appeared before it was removed.
- A statement, under penalty of perjury, that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
- Your name, mailing address, and telephone number, plus a statement that you consent to the jurisdiction of the U.S. Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which Rossilite may be found), and that you will accept service of process from the person who submitted the original notice, or their agent.
If we receive a valid counter-notification, we will forward it to the person who submitted the original notice. Unless that person notifies us that they have filed a court action seeking to restrain the allegedly infringing activity, we may restore the removed material in 10 to 14 business days after we receive the counter-notification.
4. Repeat Infringers
We maintain and reasonably implement a policy of terminating, in appropriate circumstances, the accounts of users who are repeat copyright infringers. We may also suspend or terminate an account, remove content, or restrict access at any time for conduct we reasonably believe infringes the rights of others, in accordance with our Terms of Service.
5. A Note on Private Content
Most content in Projects is private to a user or shared only with the members of a specific board; it is not published to the public. If you are reporting material you cannot see yourself, please tell us as much as you can about where it appears so we can identify it. We may need to ask you for additional detail before we can act.
